Communiqué on the Prevention of Unfair Competition in Imports (Communiqué No: 2025/41) (Turkey)
1) What has changed or been introduced compared to the previous regulation?
With Communiqué No: 2025/10, published in the Official Gazette dated 25.05.2025 and numbered 32910, an anti-dumping investigation was initiated concerning “aluminium frames for photovoltaic panels” classified under GTIP 8541.90.00.00.11 and originating in the People’s Republic of China, and the procedural framework of the investigation was established.
With Communiqué No: 2025/41, based on the preliminary findings of the ongoing investigation, a provisional anti-dumping measure has been introduced for the same product. Accordingly, imports are now subject to the collection of a security (deposit) calculated as a percentage of the CIF value. Security rates are determined on a company-specific basis, while imports from producers/exporters not individually listed are subject to a “Others” rate of 31.40%.
2) Summary
- Product / HS Code: 8541.90.00.00.11 – Aluminium frames for photovoltaic panels (originating in China)
- Application: Collection of security upon importation under the free circulation regime
- Security rates (percentage of CIF value):
- Duration: The provisional measure will remain in force for a maximum period of six months, until the final decision of the investigation is published in the Official Gazette.
3) Implications for companies and required actions
- Cost and cash-flow impact: The requirement to provide security based on the CIF value creates an additional financing burden for importers and should be reflected in cash-flow planning.
- Company-specific rate risk: As security rates are applied on a producer/exporter basis, the accurate and consistent declaration of company names in commercial and customs documents is critical. Any mismatch may result in the application of the higher “Others” rate.
- HS classification and origin control: Since the measure is applied based on product definition, HS classification, and origin, importers should conduct a thorough pre-import review of tariff classification and origin documentation.
- Review of contracts and pricing: Existing contracts with Chinese suppliers should be reviewed to assess the allocation of costs arising from the provisional measure and its potential impact on pricing.
- Operational preparedness: Importers should plan in advance for security mechanisms (cash deposit or bank guarantee) and ensure close coordination with customs brokers to avoid clearance delays.
